Terms & Conditions
The terms that apply when you use this website, request an estimate, or hire Red Maple Landscaping & Tree Services LLC — including our text messaging program terms.
Last updated: September 21, 2026
These Terms and Conditions (“Terms”) govern your use of redmaplelandscapingservices.com (the “Site”) and the services provided by Red Maple Landscaping & Tree Services LLC (“Red Maple,” “we,” “us,” or “our”). By using the Site, requesting an estimate, or hiring us to perform work, you agree to these Terms.
1. Our Services
Red Maple is a family-owned, fully insured tree service and landscaping company based in Harvard, Illinois. We provide tree removal, tree trimming and pruning, stump grinding, storm damage cleanup, landscaping, lawn care and mowing, snow removal, and landscape design and installation including patios, retaining walls, concrete, and grading. We serve McHenry, Winnebago, and Boone County in Illinois and Walworth and Rock County in Wisconsin. Work outside these areas may be accepted at our discretion.
2. Estimates and Quotes
Estimates are free and carry no obligation. Unless we state otherwise in writing:
- Estimates are valid for 30 days from the date issued.
- An estimate covers only the scope of work described in it. Additional trees, additional areas, or changes you request are billed separately.
- Conditions we could not reasonably see when quoting — buried stumps, concrete or footings underground, hidden decay, hazardous limbs discovered during the work, or restricted equipment access — may require a revised price. We will inform you and obtain your approval before performing additional billable work.
- Prices assume reasonable equipment access to the work area. If access is blocked or requires hand-carrying material, additional labor charges may apply.
3. Scheduling, Weather, and Delays
Tree and landscaping work depends on weather and ground conditions. We may reschedule for rain, wind, lightning, snow, frozen or saturated ground, or other unsafe conditions. We will contact you as early as we can when a date changes. Storm emergency calls take priority over routine scheduled work and may cause delays. We are not liable for losses caused by weather-related rescheduling.
4. Property Access and Customer Responsibilities
Before we begin, you agree to:
- Confirm that you own the property or have the owner’s authorization for the work.
- Confirm property lines and identify any trees or features that are shared with, or belong to, a neighbor.
- Obtain any permits, HOA approvals, or municipal permissions required for the work, unless we have agreed in writing to handle them.
- Point out private underground utilities and irrigation — including septic systems and fields, private water or gas lines, invisible pet fences, low-voltage lighting, and sprinkler lines — which public locate services do not mark.
- Move vehicles, patio furniture, planters, decorations, and other personal property out of the work area.
- Keep people and pets clear of the work area while our crew is on site.
We will request public utility locates through the applicable state one-call service (JULIE in Illinois, Diggers Hotline in Wisconsin) where required for stump grinding or excavation. We are not responsible for damage to unmarked private lines.
5. Pricing and Payment
- Payment is due upon completion of the work unless other terms are stated in writing on your estimate or invoice.
- Larger projects may require a deposit before materials are ordered or work is scheduled. Deposits for ordered materials are non-refundable once materials have been purchased.
- Recurring services such as lawn mowing or snow removal are billed on the schedule stated in your service agreement.
- Past-due balances may accrue a late fee of 1.5% per month (18% per year) or the maximum rate permitted by Illinois law, whichever is less. You are responsible for reasonable collection costs and attorney fees on unpaid balances.
6. Cancellation
Please give us at least 24 hours’ notice to cancel or reschedule a job. Cancellations made after our crew has been dispatched or after materials have been purchased for your project may be charged for the costs already incurred. For recurring services, either party may cancel with seven days’ written notice.
7. Cleanup and Debris
Unless your estimate states otherwise, we haul away brush, logs, and debris generated by the work and rake the work area. Stump grinding produces chips and soil that are left on site and mounded over the stump unless removal and backfill are quoted. Small chips, sawdust, and minor turf marks are a normal result of this work.
8. Insurance and Liability
Red Maple carries general liability and workers’ compensation insurance. Proof of insurance is available on request. We take care to protect your property, but some impact is unavoidable in tree and excavation work — including minor lawn rutting from equipment, turf compaction, and incidental marks near the work area. Normal, unavoidable impact of this kind is not considered damage.
Report any property damage you believe we caused within 72 hours of the work so we can inspect and address it promptly. We are not responsible for pre-existing conditions, for damage to unmarked private underground utilities, or for the failure of structures, trees, or limbs we advised you about and were not authorized to address.
9. Plant and Workmanship Warranty
Hardscape and installation workmanship is warranted for one year from completion against defects in our workmanship. This warranty does not cover damage from settling due to soil conditions outside our control, vehicle traffic, de-icing chemicals, weather events, or third-party alterations.
Living material — trees, shrubs, sod, and seed — depends on watering and care after installation and is not warranted unless a written plant warranty is stated on your invoice. Where a plant warranty is provided, it requires that you follow the watering instructions we give you.
10. Photographs of Completed Work
We may photograph completed work for our portfolio, website, and social media. Photos show the property and the work only — never your name, address, or other identifying details. Tell us before or during the job if you prefer that we not photograph your property and we will honor that.

13. Accuracy of Site Content
We work to keep the Site accurate and current, but service descriptions, photographs, and pricing guidance are provided for general information. They are not an offer or a guaranteed price. Only a written estimate from us constitutes a quote for your specific property.
14. Disclaimer of Warranties
Except for the express warranties stated in Section 9, the Site and our services are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms limits any rights you have under Illinois or Wisconsin consumer protection law that cannot be waived.
15. Limitation of Liability
To the fullest extent permitted by law, Red Maple’s total liability arising out of or relating to your use of the Site or the services we perform will not exceed the amount you paid us for the work giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or loss of use, even if we were advised of the possibility of such damages. This section does not limit liability for bodily injury or property damage caused by our negligence to the extent such limitation is prohibited by law.
16. Indemnification
You agree to indemnify and hold harmless Red Maple and its owners, employees, and subcontractors from claims arising out of your breach of these Terms, your failure to obtain required permits or authorizations, your misidentification of property lines, or your failure to disclose private underground utilities.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. Any dispute arising out of these Terms or our services will be brought in the state or federal courts located in McHenry County, Illinois, and you consent to the jurisdiction of those courts. Before filing any claim, you agree to contact us first so we have a reasonable opportunity to resolve the issue directly.
18. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with your written estimate or service agreement and our Privacy Policy, constitute the entire agreement between you and Red Maple regarding the services.
19. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted to this page, and we will update the “Last updated” date above. The Terms in effect on the date of your signed estimate govern that job.
